ANTI-DISCRIMINATORY MEASURES

Discriminiation (when dealing with immigrants and immigration) is described as any distinction, exclusion, restriction or preference against a foreigner based on race, color, descent, or national or ethnic origin or religious practices and convictions with the intent to destroy or limit human rights and fundamental freedoms on political, economic, social or cultural grounds.

In order to protect people against any form of discrimination that violates their fundamental rights and freedoms, legal protection can be demanded as stated in article 53.2 of the Constitution.  According to this law, all Spaniards are considered equals before the law without any discrimination on grounds of birth, race, sex, religion, opinion, or any other personal o social condition or circumstance.  The same goes for foreigners who have obtained citizenship.

Therefore, an appeal may be made by any citizen regarding thir fundamental rights stated in the Constitution.  Citizens have the right to take their case to the common court by means of preferential and summary procedure and where appropriate, to the constitutional court by means of an appeal for constitutional protection.
